Bristol-Myers, Baxter and 3M Breast Implant Class Proceeding
The information on this page applies only to women with Bristol-Myers, Baxter or 3M breast implants, and who reside in, or had their implant surgery in, British Columbia, Alberta, Saskatchewan, Manitoba, New Brunswick, Nova Scotia, Prince Edward Island, Newfoundland, Yukon Territory, Northwest Territories or Nunavit.

A class action settlement with Bristol-Myers, Baxter and 3M has been approved by the Supreme Court of British Columbia. The settlement will pay compensation to women who had implants manufactured by Bristol-Myers, Baxter or 3M and resided in Canada, other than in Ontario or Quebec, on February 14, 1997, or who were implanted with these manufacturers' breast implants anywhere in Canada other than Ontario or Quebec.
The defendants have agreed to pay between $2.5 million and $4.3 million depending on how many women come forward with claims.
Claimants may apply for an Injury Payment if they have suffered from ruptured implants, and/or had the implants removed, and/or have suffered from local complications, such as breast pain, capsular contracture, deformity or other local problems.
Claimants who do not wish to make an injury claim may apply for an Expedited Payment.
The deadline for non-British Columbia residents to opt into the settlement and for British Columbia residents to opt out of the settlement is December 2, 2005.
The deadline for filing Expedited or Injury Claims is February 1, 2006.
