Bio:

Mitchell joined the firm in 2004 following his call to the British Columbia Bar.  Since that time, he has successfully represented his clients in both Provincial and Supreme Court trials.  When appropriate, Mitchell has assisted his clients to resolve their cases through mediation or by negotiating settlements directly with opposing parties—both of which methods are sound alternatives to having cases decided in court.

Mitchell’s clients are primarily victims of motor vehicle accidents.  Mitchell also has significant experience assisting clients who have been injured in other circumstances, such as “slip-and-fall” cases, in their actions against negligent property owners who have caused injury due to poor maintenance or unsafe conditions.

Representative Work:  

Mitchell has a keen interest and considerable experience in preparing for and attending “chambers” applications.  This is when the lawyers for both parties will attend at court before a judge or a master to argue about specific aspects of how a lawsuit should be conducted.  From a plaintiff’s perspective, this usually means that Mitchell will fight to protect his clients from unnecessary invasions into their privacy or having to attend repetitive medical assessments.

Mitchell has represented many clients in cases that the Insurance Corporation of British Columbia (ICBC) has deemed to be in its Low Velocity Impact (LVI) Program.  These cases can be settled in most circumstances, despite ICBC’s initial denial of the claim.  In a case where ICBC maintains its denial, Mitchell will represent his client at a trial in the appropriate forum, whether that is in Provincial or Supreme Court.

Positions:

Mitchell has been a member of the Victoria Bar Association Executive since 2009.  Previously, Mitchell served as the co-chair of the Young Lawyers subsection of the Canadian Bar Association (BC Branch) from 2005 to 2009.
